Single-User License Agreement

01.Parties and Definitions

"Licensor" refers to The Chart Whisperer, the sole proprietor, creator, and owner of all products described herein.

"Licensee" or "You" refers to the individual who has purchased or otherwise obtained access to one or more Licensed Products, whose identity is tied to the email address used at time of purchase.

"Licensed Products" includes, without limitation: the ETH Continuation Acceleration Protocol (all versions and tiers), the BTC Continuation Acceleration Protocol (all versions and tiers), all associated Journal systems, all associated Level 1 and Masterwork variants, Pine Script indicators, bonus materials, and any future updates delivered to the Licensee.

"Derivative Works" means any work that is based upon or adapted from the Licensed Products, including translated, transformed, or otherwise modified versions.

02.Grant of License

Subject to the terms and conditions of this Agreement and upon receipt of full payment, the Licensor grants the Licensee a limited, non-exclusive, non-transferable, non-sublicensable, personal, single-user license to access and use the Licensed Products solely for the Licensee's own personal trading activities.

03.Permitted Uses

• Access and use the Licensed Products on devices owned or controlled exclusively by the Licensee
• Apply the methodologies, concepts, and frameworks described within the Licensed Products to the Licensee's own personal trading activities
• Make a single backup copy of the Licensed Products for personal archival purposes, provided such copy is not distributed, shared, or made accessible to any third party
• Reference the general concepts of the methodology in personal trading notes, provided such references do not reproduce the proprietary content, scoring systems, module frameworks, or original text of the Licensed Products

04.Prohibited Uses & Restrictions

The Licensee expressly agrees NOT to:

• Share, distribute, forward, upload, or transmit any portion of the Licensed Products to any third party, including but not limited to: Telegram groups, Discord servers, Notion databases, Google Drive, Dropbox, Reddit, YouTube, TikTok, X (Twitter), and all other platforms
• Resell, sublicense, rent, lease, lend, or transfer the Licensed Products or any rights therein to any person or entity
• Reproduce or excerpt substantial portions of the Licensed Products' text, module structures, scoring systems, checklists, playbooks, or frameworks in any medium
• Create derivative works that are substantially based on the Licensed Products' methodology, structure, scoring systems, or original expression — including competing products, courses, signals services, or educational content
• Teach, train, or instruct others — whether for compensation or otherwise — using the Licensed Products' proprietary frameworks, terminology, confluence scoring system, or module architecture without a separate Commercial License (contact Licensor)
• Screenshot, screen-record, or capture the Licensed Products for the purpose of distribution or reproduction
• Reverse engineer, decompile, or extract source code or underlying logic of interactive components
• Use the Licensed Products' brand name, methodology names, or associated trademarks (including "The Chart Whisperer", "Continuation Acceleration Protocol", "CAP Framework") in any commercial, promotional, or public context without written permission
• Post, upload, or share access links provided by the Licensor for product delivery

05.Intellectual Property

All Licensed Products, including but not limited to: the written content, module architecture, confluence scoring systems, entry/stop/target methodologies, journal structures, React application code, visual design, proprietary inverted Fibonacci notation system, and the "Continuation Acceleration Protocol" methodology framework, are and shall remain the exclusive intellectual property of the Licensor, protected under applicable copyright, trade secret, and intellectual property laws.

This Agreement does not transfer any title or ownership interest in the Licensed Products to the Licensee. The Licensor retains all intellectual property rights, including the right to modify, adapt, license, sell, or discontinue the Licensed Products at any time.

The Licensee acknowledges that the Licensed Products represent significant proprietary investment and that any unauthorised use, reproduction, or distribution constitutes irreparable harm to the Licensor for which monetary damages alone would be inadequate.

06.Payment and Delivery

Access to Licensed Products is granted upon confirmed receipt of full payment. The Licensor will deliver a secure, single-use download link to the email address provided at time of purchase within 24 hours of payment confirmation. Download links expire after 72 hours or after first use. The Licensee is responsible for downloading and securely storing their copy.

Bundle discounts (savings of $50 USD) and coaching rate discounts (10% reduction) apply only to the specific product combinations described on the sales page at time of purchase and must be claimed in a single transaction.

07.Refund Policy

Every purchase carries a 24-hour money-back window from the purchase timestamp, honoured without requiring a reason. Accessing or downloading the Licensed Products does not void that window. Full terms, including the circumstances honoured beyond 24 hours, are set out in the refund policy.

Due to the immediately deliverable and inherently reproducible nature of digital products, and the proprietary and confidential nature of the content therein, sales become final once that 24-hour window has closed. Where a refund is issued, the licence granted under this Agreement terminates immediately and all copies must be destroyed.

The Licensee is strongly encouraged to review all available free materials (including the ETH live demo) and to direct any pre-purchase questions to the Licensor before completing a purchase. By completing a purchase, the Licensee confirms they have sufficient information to make an informed decision.

08.Disclaimer of Trading Results

IMPORTANT: The Licensed Products are educational and informational tools only. They do not constitute financial advice, investment advice, or trading recommendations.

Trading cryptocurrency perpetual futures and other financial instruments involves substantial risk of loss. Past performance described or implied in marketing materials, testimonials, or the Licensed Products themselves is based on documented methodology analysis and does not guarantee, represent, or predict future results. Individual results will vary significantly based on market conditions, individual skill, risk management, and other factors outside the Licensor's control.

The Licensor makes no warranties, expressed or implied, regarding specific profitability, win rates, or trading outcomes achievable using the Licensed Products. The Licensee accepts full responsibility for all trading decisions made, whether or not influenced by the Licensed Products.

Never risk more capital than you can afford to lose entirely.

09.Limitation of Liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: trading losses, lost profits, loss of data, loss of opportunity, or any other damages arising out of or in connection with the use or inability to use the Licensed Products, regardless of the theory of liability and even if the Licensor has been advised of the possibility of such damages.

The Licensor's total aggregate liability to the Licensee shall not exceed the amount paid by the Licensee for the specific Licensed Product giving rise to the claim.

10.Enforcement & Remedies

The Licensee acknowledges that any breach of Sections 04 (Prohibited Uses) or 05 (Intellectual Property) will cause immediate, substantial, and irreparable harm to the Licensor that cannot be adequately compensated by monetary damages alone.

In the event of a breach or suspected breach, the Licensor reserves the right to:

• Immediately revoke the Licensee's license without notice or refund
• Seek injunctive relief in any court of competent jurisdiction without the requirement of posting bond or proving actual damages
• Seek statutory and/or actual damages under applicable copyright law, including enhanced damages for willful infringement
• File DMCA takedown notices against infringing content on any platform
• Pursue all other available legal and equitable remedies
• Recover attorneys' fees and costs incurred in enforcing this Agreement

The Licensor actively monitors for unauthorised distribution of Licensed Products. Purchaser information (including email address, IP address, and transaction ID) is retained and may be used to identify the source of any leaked materials.

11.Coaching Services Terms

1:1 coaching sessions ("Sessions") offered by the Licensor are subject to the following additional terms:

• Non-refundable: Confirmed Sessions are non-refundable. Cancellations with less than 24 hours notice forfeit the full session fee.
• Reschedule Policy: Sessions may be rescheduled once with minimum 24 hours notice. Further rescheduling may incur a rescheduling fee.
• Educational Purpose: Sessions are educational only and do not constitute financial advice or trading recommendations. The Licensee remains solely responsible for all trading decisions.
• Recording: Sessions are recorded for the Licensee's private review only. Recordings may not be distributed, published, or shared.
• Bundle Discount: The 10% coaching discount for bundle purchasers must be claimed at time of booking by selecting the appropriate bundle tier. It cannot be applied retroactively to completed sessions.
• Conduct: The Licensor reserves the right to terminate a Session and forfeit the session fee for abusive, harassing, or inappropriate conduct by the Licensee.

12.Governing Law

This Agreement shall be governed by and construed in accordance with internationally accepted principles of contract and intellectual property law, with particular reference to:

• The Berne Convention for the Protection of Literary and Artistic Works
• The WIPO Copyright Treaty
• The Digital Millennium Copyright Act (DMCA) with respect to online copyright enforcement
• The laws of the jurisdiction of the Licensor's principal place of business

Disputes arising from this Agreement shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration. The language of any arbitration shall be English.

By completing a purchase or accessing any Licensed Product, you confirm that you have read, understood, and agree to be bound by all terms of this Single-User License Agreement. This Agreement constitutes the entire agreement between the parties regarding its subject matter and supersedes all prior agreements, representations, and understandings.
